(a) Any person seeking a panoram premises license, panoram operator's license, panoram device license, or panoram manager's license, shall file a written application with the clerk on a form provided by the clerk for that purpose. The clerk, upon receipt of a complete application shall refer such application to the police department, and other appropriate city departments, for a full investigation as to the truth of the statements contained therein, and as to any and all other matters which would aid the clerk in determining compliance with this chapter and other applicable law. Upon receipt of a complete application, the clerk shall further issue a temporary license, pending disposition of the application. The temporary license shall expire upon the issuance of a license or renewal or upon a notice of nonissuance. The holder of a temporary license issued under this section is subject to all of requirements, standards, and penalties provided for in this chapter.

(b) Applicants for any license or renewal thereof under this chapter shall provide the following information and certify under penalty of perjury that the information is true and accurate:

(1) With each application for a panoram premises license or renewal thereof, applicants shall provide:

(A) The name, address and telephone number of each person applying for the license;

(B) The name, address and telephone number of each person holding an ownership, leasehold or other interest in the panoram premises;

(C) The name, address and telephone number of the manager, or other person, responsible for the operation of the premises;

(D) The address of the premises;

(E) The number of panoram devices to be located on the premises; and

(F) A sketch or drawing sufficient to show the layout of the premises, including all information necessary to determine whether the premises complies with the provisions of this chapter.

(2) With each application for a panoram device license or renewal thereof, applicants shall provide the following:

(A) The name, address, and telephone number of each person applying for the license;

(B) The name, address, and telephone number of each person holding an ownership, leasehold, or other interest in the panoram premises;

(C) The name, address, and telephone number of each person responsible for the operation of the panoram premises;

(D) The address at which the panoram device is to be located; and

(E) A description of the panoram device, including make, model, and serial number.

(3) With each application for a panoram operator's license or renewal thereof, applicants shall provide the following:

(A) For the applicant and for each applicant control person the applicant shall supply the name, home address, home telephone number, date and place of birth, and social security number. If the applicant is a partnership, all such information must be provided for all general partners;

(B) The business name, address, and telephone number of the panoram premises;

(C) If the applicant is a corporation, the names, addresses, telephone numbers, and social security numbers of all operators and of all corporate officers and directors. The same information shall be required from each parent company or affiliate;

(D) The name, address and telephone number of the owner of the property on which the panoram premises is located;

(E) The names, addresses, and telephone numbers of all employees of the panoram premises;

(F) A statement detailing whether the applicant or any operator, partner, corporate officer, director, or shareholder of any class of an operator's stock, holds any other licenses under this chapter or any adult entertainment or sexually oriented business ordinance, including live adult entertainment, motion picture theaters, and panorams from this city or another city, county, or state, and if so, the names and addresses of each other licensed business and the jurisdiction(s) in which such businesses are located; and

(G) A description of the business history of the applicant or control person in owning or operating adult entertainment or sexually oriented businesses. The applicant must provide the names, addresses and dates of operation for such businesses and must provide whether the applicant or control person, in previously operating in this or another city, county or state, has had a business license or adult business license revoked or suspended, the reason therefore, and the activity or occupation of the applicant subsequent to such action, suspension or revocation.

(H) For the applicant and all control persons, a list of any and all criminal convictions, other than parking or minor traffic offenses, including the dates of conviction, the nature of the crime, name and location of court and disposition.

(I) A complete set of fingerprints for the applicant and all applicant control persons taken by the city of Selah police department.

(4) With each application for a panoram manager's license or renewal thereof, applicants shall provide the following:

(A) The applicant's name, home address, home telephone number, date and place of birth, social security number, and the name, address and phone number of the panoram premises at which the applicant will work;

(B) The applicant's prior criminal convictions, including the crime(s) convicted of, place, and the approximate date of each such conviction.

(C) With the application an applicant shall present picture identification, which shall include:

(1) A motor vehicle operator's license, issued by the state of Washington, bearing the applicant's photograph and date of birth; or

(2) A Washington State issued identification card bearing the applicant's photograph and date of birth, or

(3) any other form of reliable picture identification bearing the applicant's photograph and date of birth.

(D) A complete set of fingerprints for the applicant and all applicant control persons taken by the city of Selah police department.

(E) Certification that the applicant for a manager's license is an authorized agent of the owner, operator, or applicant control person, and that the manager is acting on behalf of and in furtherance of that person's interest in managing and maintaining a panoram premises. (Ord. 1646, § 1, 2005.)
