As used in this chapter, the following words and phrases shall have the following meanings unless the context clearly requires otherwise:

(a) "Applicant" means the individual or entity seeking any form of panoram license in the city of Selah.

(b) "Applicant control person" or "control persons" means all partners, corporate officers, directors, and managers who have responsibility for management or control of the panoram business, regardless of whether such person's name appears on corporate filings, license applications, or other official documents of the applicant.

(c) "Clerk" means the city clerk-treasurer and/or his or her designee.

(d) "Manager" means any person who manages, directs, administers or is in charge of, the affairs and/or conduct of a panoram premises.

(e) "Member of the public" means any customer, patron, club member, or person, other than employees of the panoram premises, who is invited or admitted entry to a panoram premises.

(f) "Panoram," "preview," "picture arcade," or "peep show" means any device which, for payment of a fee, membership dues or other charge, is used to view, exhibit or display a film, video tape, disc, or downloaded material. All such devices are denominated in this chapter by the terms "panoram" or "panoram device." The terms "panoram" and "panoram device" as used in this chapter do not include any such devices associated with gambling regulated by the state.

(g) "Panoram premises" means any premises or portion of any premises in which any panoram device is located and to which members of the public are admitted and where persons under the age of eighteen years are denied entry.

(h) "Panoram station" means a portion of any panoram premises on which a panoram device is located and where a member of the public would ordinarily be positioned while watching the panoram device also referred to herein as a "panoram booth."

(i) "Person" means any individual, partnership, corporation, trust, incorporated or unincorporated association, marital community, joint venture, governmental entity, or other entity or group of persons, however organized. (Ord. 1646, § 1, 2005.)
