(a) Unattended Nuisance Vehicles. An unattended nuisance vehicle means a vehicle not within the meaning of RCW 46.55.010(12) which is by this definition subject to impound after remaining in substantially the same location for twenty-four consecutive hours or longer upon any portion of a highway, street, road, public way, or public parking lot for an additional fourteen consecutive days after notice is given by a law enforcement officer in both of the following ways:

(1) When the vehicle displays proper current registration or license plates so that the owner may be ascertained, or when the owner of the vehicle is determined by the police department from other information available, then the chief of police or his or her agent shall send notice, substantially as appears below, to such owner by certified mail, return receipt requested:

NOTICE OF IMPOUNDMENT: Notice is given to you of a vehicle described as follows: ____________ that it will be impounded by the city of Selah pursuant to Selah Code Chapter 8.80 if the vehicle is not removed within fourteen (14) days of ____________ / ____________ / ____________ (date). The vehicle will not be impounded if you request a hearing in writing delivered to the Selah Police Department within fourteen (14) days of the Notice of Impoundment by stating "Request for Pre-Impoundment Hearing." The notice must be delivered to the Selah Police Department at 113 South Second Street, Selah, Washington, within the fourteen (14) day period described above.

(A) If the Selah police department has actual knowledge that the owner of the vehicle is residing at an address different from the vehicle registration certificate or the license plate information or other public records, and if such different address is known to the chief of police or his or her agent who gives the notice, then the copy of the notice contained in subsection (1) of this section shall be mailed by certified mail, return receipt requested, addressed to the correct address or personally served upon the owner.

(2) On the date of mailing, the law enforcement officer shall place on the vehicle the Notice of Impoundment described in Selah Code § 8.80.011(a)(1). (Ord. 1057, § 1, 1992.)
