(a) Every longboard when in use during the hours of darkness as defined in RCW 46.37.020 shall be equipped with a lamp affixed to the front of the longboard or on the front of the helmet worn by the person using the longboard which shall emit a white light visible from a distance at least five hundred feet to the front and with a red reflector affixed to the rear of the longboard which shall be visible from a distance of five hundred feet when directly in front of lawful lower beams on a motor vehicle. A lamp emitting a red light visible from a distance of five hundred feet may be affixed to the longboard and used in addition to the required red reflector or a light-emitting diode flashing taillight visible from five hundred feet may also be used in addition to the required red reflector. It is unlawful to use a longboard during hours of darkness unless equipped as provided in this section.

(b) Persons using longboards on public roadways are required to move to the shoulder of the roadway if the person's use of the longboard is impeding the flow of traffic.

(c) Penalty for Violations of this Section. Any person violating the provisions of this section shall be deemed to have committed a traffic infraction and shall be issued a civil infraction citation. The civil infraction citation shall be filed with Selah municipal court. The civil monetary fine shall be thirty dollars for a first offense, one hundred fifty dollars for a second offense, and two hundred fifty dollars for a third offense. For persons under the age of sixteen years of age, the parent(s) or legal guardian(s) of the person shall be responsible for payment of the fine. (Ord. 1921, § 1, 2013.)
