(a) It is unlawful for any person or entity to violate any provision or to fail to comply with any of the requirements of this chapter. Any person violating any of the provisions or failing to comply with any of the requirements of this chapter shall be punished by a fine of two hundred fifty dollars. Said fine shall be imposed through a civil infraction processed through the city's municipal court.

(b) In addition to the penalty described in subsection (a) of this section, each person or entity engaging in a fundraising car wash that fails to use a car wash discharge collection device may be subject to separate enforcement action and penalties processed through the Washington State Department of Ecology.
