(a) Office. There is created the office of fire chief, which office shall be filled by appointment of the mayor subject to confirmation both by a majority of the entire city council and by the fire commissioners (or a binding decision via the dispute-resolution process), if any, under any then-existing joint operating agreement or other contractual agreement between the city of Selah and Yakima County Fire Protection District No. 2 or its successor or replacement. The terms of employment of the fire chief may be specified by a contract executed by the mayor subject to confirmation both by a majority of the entire city council and by the fire commissioners (or a binding decision via the dispute-resolution process), if any, under any then-existing joint operating agreement or other contractual agreement between the city of Selah and Yakima County Fire Protection District No. 2 or its successor or replacement. No provision of such contract may be contrary to state law, any provision of the Selah Municipal Code, any city ordinance or resolution, or any then-existing contractual agreement between the city of Selah and any other entity including but not limited to Yakima County Fire Protection District No. 2 or its successor or replacement.

(b) Scope of Authority. The fire chief shall be the head of the entire fire department, shall supervise and direct all fire department members, and shall develop, implement and enforce all rules and regulations of the fire department, under the direction of the mayor and the fire commissioners, if any, under any then-existing joint operating agreement or other contractual agreement between the city of Selah and Yakima County Fire Protection District No. 2 or its successor or replacement.
