(a) The provisions of this title shall apply to any new development, construction or use within the city of Selah's municipal boundaries, designated as a critical area inside shoreline jurisdiction, designated as shoreline jurisdiction and designated as a special flood hazard area under the National Flood Insurance Program. Those shorelines within the city of Selah and its urban growth area which have been inventoried and found to meet the criteria as a shoreline of the state are as follows:

(1) Streams, Rivers and Floodplains.

(A) Naches River.

(B) Yakima River.

(b) Other rules and regulations, including the city of Selah Municipal Code (Title 10, Zoning, and Title 11, Building Codes), shall remain in full force and effect as they apply to a designated critical area or shoreline. Wherever the requirements of the shoreline master program conflict with the requirements of the applicable zoning ordinance, the subdivision ordinance or any other lawfully adopted city rules or regulations, the most restrictive standards shall govern.

(c) The city of Selah critical areas ordinance (CAO), Chapter 11.50 (Ordinance No. 2124, dated May 11, 2021), is incorporated herein by this reference into this shoreline master program, except as noted below. All references to the critical areas ordinance, Chapter 11.50, are for this specific version.

(1) If the provisions of Chapter 11.50 and other parts of the shoreline master program conflict, the provisions most protective of the ecological resource shall apply, as determined by the city.

(2) Provisions of Chapter 11.50 that are not consistent with the SMA (Chapter 90.58 RCW) shall not apply in shoreline jurisdiction. Specifically, the following subsections shall not apply in shoreline jurisdiction:

(A) Section 11.50.010, Purpose and intent;

(B) Section 11.50.050, Exemptions and nonconforming uses;

(C) Section 11.50.060, Exceptions;

(D) Section 11.50.090, Appeals; and

(E) Section 11.50.100, Enforcement. (Ord. 2123, § 1 (Att.), 2021.)
